1. Acceptance of Terms

By accessing or using the FNXT AI Trading Benchmark ("Platform") at fnxt.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Platform. We reserve the right to modify these Terms at any time without prior notice.

2. Description of Service

The Platform provides AI-powered financial market intelligence, multi-model evaluation benchmarks, strategy testing algorithms, and simulated signal analytics. The Platform is strictly a scientific research, benchmarking, and educational software platform. The Platform does NOT operate as a financial institution, custodian, broker-dealer, exchange, or investment fund, and does NOT provide trading, brokerage, or asset custody services.

3. No Financial Advice & Benchmark Disclaimer

The Platform does NOT provide financial, investment, brokerage, tax, or legal advice. All analyses, AI benchmark scores, simulated signals, model evaluations, and trading strategies generated by the Platform are strictly for educational, research, and benchmarking purposes only. You are solely responsible for your own independent financial actions and trading decisions.

4. User Responsibilities

As a user, you acknowledge and agree that:

  • You are at least 18 years old and legally able to enter into binding contracts.
  • You are solely responsible for all trading decisions made through the Platform.
  • You understand the inherent risks of tokenized asset and digital currency trading, including the risk of total loss.
  • You will comply with all applicable laws and regulations in your jurisdiction.
  • You are responsible for maintaining the confidentiality of your account credentials and API keys.
  • You will not use the Platform for any illegal, fraudulent, or unauthorized purpose.
  • You are solely responsible for any tax obligations arising from your trading activities.

5. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the Platform will be accurate, reliable, or profitable.
  • AI-generated analyses, signals, or strategies will produce positive returns.
  • Any defects in the Platform will be corrected.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, in no event shall the Platform, its operators, developers, affiliates, or any associated parties be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
  • Loss of profits, data, or goodwill
  • Financial losses resulting from trading activities
  • Losses resulting from unauthorized access to your account
  • Losses from exchange API integration failures or delays
  • Losses from AI provider errors, hallucinations, or incorrect analyses
  • Any damages arising from the use or inability to use the Platform

7. Indemnification

You agree to indemnify, defend, and hold harmless the Platform and its operators from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any applicable law or regulation.

8. Third-Party Services

The Platform integrates with third-party services including but not limited to digital asset exchanges (Binance, Bybit, Gate.io), AI providers (OpenAI, Google, Anthropic, NVIDIA, OpenRouter), TradingView, and Telegram. We are not responsible for the availability, accuracy, or performance of these services. Your use of third-party services is subject to their respective terms and conditions.

9. API Keys & Automated Trading

If you provide exchange API keys for automated trading:

  • You do so entirely at your own risk.
  • You are solely responsible for configuring appropriate API permissions and restrictions.
  • We strongly recommend using read-only or trade-only keys with IP restrictions and no withdrawal permissions.
  • We are not liable for any trades executed, failed, or delayed through the Platform.
  • You acknowledge that automated trading systems can malfunction and cause significant financial loss.

10. Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, without prior notice. You may delete your account at any time.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
